Welcome to The Video Biography Company. By accessing our website or engaging our services, you agree to the following Terms of Service. Please read them carefully, as they are designed to protect both you (the client) and us (the company).
1. Services Provided
The Video Biography Company specializes in creating customized films, including but not limited to:
Family and personal video biographies
Legacy tributes
Corporate and organizational histories
Highlight films for special occasions (e.g., birthdays, anniversaries, memorials)
Each project is tailored to the client’s needs and may include interviews, photographs, historical materials, music, and editing.
2. Client Responsibilities
Content Ownership: You represent that you have the legal right to provide any photographs, videos, music, documents, or other materials submitted for use in your film.
Accuracy: You are responsible for ensuring all information provided is accurate to the best of your knowledge.
Permissions: You are responsible for obtaining consent from any individuals you request to be interviewed or included in the video.
3. Intellectual Property & Marketing Use
Client Ownership: The completed video biography is your property once full payment has been received.
Company Rights: With your consent, The Video Biography Company may use short excerpts (no more than a few minutes) from your project as examples of our work for promotional and marketing purposes, including on our website, social media, and presentations to potential clients.
No Unauthorized Use: Except as permitted above, we will not sell, license, or otherwise distribute your video without your written consent.
4. Payment & Refunds
Payment Schedule: A non-refundable deposit is required at the time of contract signing to secure your project. Typically, payment is made in three installments:
Deposit at contract signing
Second payment when the review edit is delivered
Final payment upon completion and delivery of the finished video
While this is our standard payment schedule, variations may be made in certain cases if agreed upon in writing.
Because of the customized nature of our work, payments are generally non-refundable once production has begun. Refunds may be considered on a case-by-case basis at the company’s discretion.
5. Editing & Revisions
Each project includes up to three rounds of revisions. Additional revisions can be requested for an agreed-upon fee.
Revisions must be requested within 15 days of receiving the draft.
6. Production Timelines
Typical production time is 8–10 weeks, but may vary depending on project scope.
Rush projects can be accommodated at an additional fee.
While we strive to meet deadlines, delays caused by illness, technical issues, or unforeseen circumstances may occur.
7. Limitation of Liability
We take great care with your materials, but cannot be held liable for the loss, damage, or deterioration of physical photos, tapes, or other items provided to us. All items are returned after use.
We are not responsible for third-party hosting outages (e.g., YouTube, Vimeo, file transfer services).
Our liability, in any case, is limited to the amount paid for services.
8. Privacy & Confidentiality
All interviews, footage, and client-provided materials are treated with strict confidentiality.
We do not share your video or personal data with outside parties except as described in our Privacy Policy.
9. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
